SUBJECT
These general terms and conditions define the conditions applicable to sales concluded between:
on the one hand, the persons wishing to make a purchase via the https://barodEvel.com, hereinafter referred to as the customer.
and on the other hand Baro d’Evel, which operates the above-mentioned website.
Baro d’Evel reserves the right to change these Terms and Conditions at any time. These can be consulted on barodevel.com. Any modification will be effective as soon as the modified T&Cs are posted online. They are brought to the attention of and accepted without reservation by the customer before any validation of the order.
PRODUCTS – STOCKS
The information on the product sheets allows the customer to know the characteristics of the product before ordering. Consequently, any claim resulting from negligent verification cannot be accepted.
It can happen that a product displayed in stock at the time of the order, is no longer displayed at the time of preparation of the package. In this case, Baro d’Evel undertakes to notify the customer as soon as possible, and to propose a solution satisfactory to both parties (refund or credit note).
PRICE – PAYMENT
The prices posted on the site are inclusive of all taxes (including VAT), but do not include shipping costs. Baro d’Evel reserves the right to reflect any change in the VAT rate in the prices displayed on the website and the right to change its prices at any time. However, only the price displayed at the time of the order will be applicable to the customer.
Payment of the totality of the order is required during the validation. Payment will be made by secure credit card via the payment module of our partner Stripe. The order will only be validated after effective receipt of payment. In the event of non-validation of a payment, the order will be cancelled and Baro d’Evel will inform the customer.
Baro d’Evel reserves the right to refuse to fulfill an order from a customer who has not fully settled a previous order or with whom a payment dispute has not been settled. Baro d’Evel cannot be held responsible for any fraudulent use of any means of payment.
DELIVERY
Deliveries are made to the address provided on the order form. The information transmitted to Baro d’Evel during the order process is the responsibility of the customer. These cannot be modified after the order has been confirmed. In the event of an error in the wording of the recipient’s contact details, Baro d’Evel cannot be held responsible for the impossibility of delivering the ordered items.
The order will be dispatched within 2 working days from the 1st working day following the date of the order.
The risks are at the client’s expense from the time the products leave Baro d’Evel’s premises. In the event of damage during transport, the justified complaint must be made to the carrier within three days of delivery.
RETRACTATION
Any individual customer has a withdrawal period of fourteen (14) days from the date of receipt of the order. Regardless of the reason for the withdrawal, you must notify Baro d’Evel within the above-mentioned period by email or post informing you of the implementation of your right of withdrawal. You will then return the products as soon as possible and, at the latest, within fourteen (14) days following the communication of your decision to withdraw. The products will be sent in perfect condition, in their original packaging, and under conditions allowing them to be put back on sale by Baro d’Evel at the following address:

It is specified that the costs and risks of return are at your expense, you will not be able to claim a refund from Baro d’Evel. We recommend that you keep any proof of this return. Once the products are received, you will be refunded the full amount paid – including the initial shipping costs.
RESPONSIBILITIES
Baro d’Evel is committed to providing all the care used in the profession to satisfy its customers. Nevertheless, Baro d’Evel shall not be held liable for the non-performance of the contract concluded due to a fortuitous event or a case of force majeure such as, and without limitation, disasters, fires, floods, failure or breakdown of equipment, means of transport, communication, or as a result of the customer’s action.
Baro d’Evel cannot be held liable for any delay due to a supplier.
Baro d’Evel’s liability shall in any event be limited to the amount of the order.
INTELLECTUAL PROPERTY
All elements of Baro d’Evel’s website are and remain its intellectual and exclusive property. No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or sound.
DISPUTE RESOLUTION
These online sales conditions are subject to French law. In the event of a dispute, the French courts have jurisdiction.
